Position Summary

The Contract and Claims Manager will play an integral role within the Ontario Track, Signals and Client Services teams. Serving as a key point of contact between PNR RailWorks Inc. and clients/third parties to ensure timely review, contract preparation, and a negotiation strategy aligning with internal requirements. The Contracts Manager will develop best practices internally for systems and processes. Liaising with various departments within the organization, the Contracts Manager will be a true partner with operations and have involvement in project bids, contractual aspects, legal issues and project claims involvement/management.

Primary/Essential Responsibilities and Duties

  • Review Prime Contracts, subcontracts, and Purchase Orders to understand obligations, liabilities and risks; highlight risks and work with legal and technical teams to establish an appropriate regime for managing the obligations, risks, and liabilities;
  • Negotiation of Contracts, Supply Agreements, Purchase Orders, etc. with downstream contractors and suppliers;
  • Prepare, develop, and manage timely contractual correspondence and notices in accordance with contractual requirements;
  • Develop and maintain efficient systems and processes for identifying and capturing any potential commercial issues and changes;
  • Ensure a current log of all issues and change orders is maintained for each contract.
  • Ensure accurate issue files for all contractual/commercial issues are maintained for each contract;
  • Prepare claims and negotiate resolutions and change orders;
  • Manage the administration of upstream and downstream contracts;
  • Implement proper document control processes and ensure compliance;
  • Identification and tracking of deliverables.
  • Liaise with legal team on a variety of matters and issues, including potential and actual project claims.
  • Ensure timely receipt (for subs) and submission (to clients) of pay applications in accordance with contractual and Construction Act requirements;
  • Perform periodic risk assessments and provide recommendations for any available mitigation measures;
  • Assist the bids and proposals teams in reviewing RFQs, RFPs, and associated documents, including proposed contracts;
  • Preparation of responses to RFQs, RFPs, and other bid and proposal documentation.
  • This role is demanding and it is expected that the successful candidate will work additional hours, over and above a 40+ hour week and, at times, outside of normal business hours;
  • Performs other duties as assigned.

Required Skills and Qualifications

  • Five (5) to ten (10) years' experience as a Contract Manager with preference in the Construction industry and or/project management experience with a focus on contract administration;
  • A Bachelor's degree with preference in Engineering, or relevant discipline;
  • Excellent understanding of contractual language;
  • Excellent communication skills, both oral and written;
  • Ability to multi-task and work in a fast-paced team environment dealing with multiple projects and contracts at the same time;
  • Meticulous attention to detail and strong organizational skills;
  • Proficiency in Word and Excel is mandatory;
  • Knowledge and understanding of other software systems including Primavera P6 would be an asset;
  • Ability to grasp technical and commercial issues, understand how they fit within the contractual context, and develop appropriate written positions to satisfy legal and contractual requirements;
  • A legal background will be considered an asset but is not required.

Physical Requirements and Working Conditions

  • Primarily works indoors but may occasionally visit a construction site;
  • Frequently sits, stands, walks, reads, writes and uses a computer/keyboard;
  • Standing, speaking for intermediate intervals of time;
  • Will act as a representative for internal/external inquiries.
